AmpCharge Driver Portal Terms of Use
This is a website operated by Ampol Energy (Retail) Pty Ltd (ABN 21 652 913 347) for and on behalf of itself and its related bodies corporate (collectively referred to as "Ampol") under the domain name customer.ampol.com.au/driver-portal (“AmpCharge Driver Portal”).
Ampol provides electric vehicle home charging solutions in Australia under its brand “Ampol Energy” or “AmpCharge”. This website is an online dashboard for home EV charging management available at customer.ampol.com.au/driver-portal (“AmpCharge Driver Portal”). You may use the AmpCharge Driver Portal in conjunction with any EV home charging equipment purchased from us.
These terms and conditions govern your access to and use of the AmpCharge Driver Portal (“Terms of Use”).
By accessing and using the AmpCharge Driver Portal or otherwise using our services, you agree that you have read and understand and are bound by these Terms of Use.
If you are accessing or using the AmpCharge Driver Portal on behalf of another person, you represent and warrant that you are authorised by that person to do so.
Changes to the Terms of Use
Ampol reserves its right to amend these Terms of Use from time to time. Any amendments become effective when published on the AmpCharge website within our driver portal terms and conditions. We recommend that you regularly check for amendments.
Intellectual Property
All copyright, trademarks and other intellectual property rights in the material on the AmpCharge Driver Portal are owned by or licenced to Ampol. Nothing in these Terms of Use transfers that ownership to you, and you agree not to dispute our ownership of such intellectual property rights at any time.
You may only use the material on the AmpCharge Driver Portal for personal non-commercial purposes, except where you obtain express written consent from Ampol or its licensors to other proposed uses.
You must not in any form or by any means reproduce, copy, adapt, distribute, store in a retrieval system, transmit, print, publish, commercialise or appropriate any material on the AmpCharge Driver Portal without the prior written consent by us or our licensors.
Your use of the AmpCharge Driver Portal
To use the AmpCharge Driver Portal and adopt your EV home charging equipment, you must create an AmpCharge Driver Portal account. You can create your account by visiting customer.ampol.com.au/driver-portal and clicking the “Don't have an account” link and following the prompts.
Creating an account and adopting your EV home charging equipment will require you to provide us with certain personal information, including your name and email address, address, telephone number (optional), EV charger serial number and adoption key.
You represent and warrant that all information you have provided to us about you is accurate and complete.
Any personal information collected as a result of your use of the AmpCharge Driver Portal including any data received from your EV charging equipment used in conjunction with the AmpCharge Driver Portal is treated in accordance with Ampol’s Home EV Charging Privacy Collection Statement and Privacy Policy, both of which form part of these Terms of Use.
You must not:
- use the AmpCharge Driver Portal in any way that is unlawful, illegal or causes damage to Ampol or any third party or breaches these Terms of Use;
- breach the security of the AmpCharge Driver Portal, introduce a virus to the AmpCharge Driver Portal, test or scan vulnerability of the AmpCharge Driver Portal, or make any unauthorised modifications to the AmpCharge Driver Portal; or
- publish or transmit any material to the AmpCharge Driver Portal that is abusive, obscene, defamatory or which a reasonable person would otherwise consider to be inappropriate.
We reserve the right to suspend or delete your AmpCharge Driver Portal account if you breach any provisions of these Terms of Use, or if you do anything that we consider, in our absolute discretion, adversely affects or is likely to adversely affect Ampol, the AmpCharge Driver Portal or our products or services.
Pricing
The basic functionality of the AmpCharge Driver Portal will be free of charge for customers who purchase Ampol home EV charging equipment.
Ampol may introduce and offer premium features for the AmpCharge Driver Portal in the future and reserves the right to charge for premium features (for example via a paid subscription plan or one-off purchase). Any additional premium features will be governed by these Terms of Use.
Disclaimer
The information contained on the AmpCharge Driver Portal is of general nature only. By accessing the AmpCharge Driver Portal you agree that the information contained on it cannot be relied on as a substitute for appropriate specialised advice tailored to your circumstances.
The material on the AmpCharge Driver Portal changes from time to time without notice. While we endeavour to keep the material on the AmpCharge Driver Portal up to date, there may be delays, errors or omissions in doing so. We are not liable for any such delays, errors or omissions.
To the extent permitted by law, Ampol makes no warranties or representations about the material on or functionality of the AmpCharge Driver Portal, including:
- the AmpCharge Driver Portal’s availability or that it is free from viruses or other harmful code, errors or defects; and
- the quality, accuracy, fitness for purpose, or completeness of the material on the AmpCharge Driver Portal.
To the maximum amount extent permitted by law, we give no warranty or undertaking, and we make no other representation to you, about the condition or compatibility of the AmpCharge Driver Portal with your EV charging equipment, its quality, fitness for purpose or safety.
Ampol will not be liable in any way (including for negligence) for any direct, indirect or consequential damages, losses or expenses arising in any way out of your use of or reliance on the AmpCharge Driver Portal or the material on the AmpCharge Driver Portal. Where we cannot exclude liability, to the maximum extent permitted by law, our liability will be limited to resupply of the relevant service, goods or equivalent goods, the cost of resupplying the service, goods or equivalent goods or, in the case of goods, the cost of repairing the goods, at our option.
For the avoidance of doubt, none of the exclusions or limitations set out in these Terms of Use will limit the Australian Consumer Law and you will retain your rights under the Australian Consumer Law.
Cookies
To collect accurate information about usage of the AmpCharge Driver Portal, and to provide a range of website features, Ampol uses "cookies" that collect anonymous traffic data from users of the AmpCharge Driver Portal (such as IP address, length of stay, pages browsed, links followed and information downloaded).
A cookie is a small amount of data containing a unique ID number that is sent to your browser from a web server and stored on your computer's hard drive. These cookies are used to develop the design and layout of the AmpCharge Driver Portal, improve applications and measure the effectiveness of our marketing activities. Cookies can also enable us to recognise your computer each time you visit the AmpCharge Driver Portal so that you do not need to log into your account each time.
You can choose if and how a cookie will be accepted by your computer by configuring preferences and options in your internet browser. However, if you choose to not receive cookies, the AmpCharge Driver Portal may not function optimally for you.
Governing Law
The Terms of Use are governed by and construed in accordance with the laws in force in the State of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of that State.
